NOTICE OF PUBLIC HEARING FOR PERMISSIVE MEDICAL LEVY

The BOARD OF RAVALI COUNTY COMMISSIONERS will hold a public hearing on Tuesday, October 13, at 1:00 p.m. in the Commissioners Conference Room (third floor) at 215 S. 4th Street, Hamilton, MT. The purpose of this hearing is to take comment regarding the proposed permissive medical levy for health care premiums and to explain the reasons for the levy.

NOTICE OF PUBLIC HEARING - BUDGET ADOPTION

The BOARD OF RAVALLI COUNTY COMMISSIONER has completed its preliminary budget for the June 30, 2010 fiscal year. The budget will be open for inspection in the Office of the Commissioners at 215 S. 4th Street (third floor), Hamilton, MT, between September 30, 2009 and October 13, 2009 during regular business hours. The Board will take comment on the preliminary budget during regular business hours until Tuesday, October 13, 2009, at 1:15 p.m. at which time the Board will hold a public hearing, then adopt the final budget and fix the tax levies. Any taxpayer or resident of the county may appear for or against any part of the budget. This public hearing will be held in the Commissioners Conference Room (third floor) at 215 S. 4th Street, Hamilton, MT.

NOTICE OF ELEMENTARY SCHOOL DISTRICT BOND ELECTION

NOTICE IS HEREBY GIVEN by the Board of Trustees (the “Board”) of School District No. 2 (Stevensville), Ravalli County, Montana (the “District”), that pursuant to a certain resolution duly adopted at a special meeting of the Board on September 21, 2009, a special election of the registered voters of the District will be held by mail ballot election on November 24, 2009 for the purpose of voting on the question of whether the Board may issue and sell general obligation school building bonds of the District in one or more series in the aggregate principal amount of up to Eight Million Eight Hundred Eighty Thousand and No/100 Dollars ($8,880,000) for the purpose of paying the costs of designing and constructing improvements to the existing school campus, including paying the costs of demolishing the junior high, four through six, and junior high shop buildings and constructing a new school facility housing classrooms, a library, and related amenities, and paying a portion of the costs of a music center, multi-purpose facility and kitchen; related improvements; and paying costs associated with the sale and issuance of the bonds (the “Project”). The bonds shall bear interest at a rate or rates to be determined by the Board at the time of the sale not to exceed 2.00% per annum, and be payable as determined by the Board no more frequently than semiannually during a term of not more than twenty (20) years as to each series of bonds. Costs of a portion of the Project in excess of $8,880,000 are anticipated to be paid by the proceeds of bonds of High School District No. 2 (Stevensville), Ravalli County, Montana, in the amount of $860,000, authorization for which is sought simultaneously herewith; however, in the event the high school bond election fails and the above proposition is approved, the District will be authorized to proceed to issue its general obligation bonds to pay the costs of demolishing the junior high, four through six, and junior high shop buildings, constructing the new school facility, the multi-purpose facility and kitchen, related costs, and costs of issuing the bonds.

The election will be conducted solely by mail ballot. Ballots will be mailed to all eligible registered voters in the District on November 4, 2009, and must be returned by each voter, by mail or in person to the County Election Administrator, Ravalli County, 215 South 4th Street, Suite C, Hamilton, Montana 59840, during regular business hours (8:00 a.m. to 5:00 p.m.), weekdays (exclusive of holidays), November 5, 2009 through November 23, 2009.

On Election Day, November 24, 2009, there will be two places for deposit for voted ballots. One will be the office of the County Election Administrator, Ravalli County, 215 South 4th Street, Suite C, Hamilton, Montana 59840, which will be open from 8:00 a.m. to 8:00 p.m., and all ballots must be in that office by 8:00 p.m. in order to be counted. Anyone needing to spoil a ballot, obtain a replacement ballot or late register MUST come to the Election Office in Hamilton. The second place of deposit will be the Stevensville High School office (hallway), 300 Park Street, Stevensville, Montana 59870, which will be open as a drop-off site only from 8:00 a.m. to 8:00 p.m.

Ballots will be opened, reconciled and counted by a sequestered Counting Board at the Ravalli County Administration Building, 215 South 4th Street, Hamilton, Montana beginning at approximately 12:00 p.m. on Election Day. No results will be released until after the election closes at 8:00 p.m.

A qualified voter who will be absent from the District during the time the election is being conducted may:

(a) vote in person in the office of the County Election Administrator as soon as the ballots are available and until noon on November 3, 2009; or

(b) make a written request prior to noon on November 3, 2009, signed by the applicant and addressed to the office of the County Election Administrator requesting the ballot be mailed to an address other than that which appears on the registration records. All ballots to be mailed will be mailed no later than November 4, 2009.

An elector may obtain a replacement ballot if his ballot is destroyed, spoiled, lost, or not received by the elector by personally appearing at the office of the County Election Administrator and by:

(a) signing an affidavit form stating the reason for the request for replacement; and

(b) if the reason given for replacement is “spoiled ballot,” by returning the spoiled ballot to the office of the County Election Administrator.

A Petition dated September 24, 2009, having been filed, pursuant to MCA Sec. 85-7-2016 and 85-7-2112 (2007) (the “Petition”), requesting this district court to determine the validity of the proceedings by which the Board of Commissioners of the Daly Ditches Irrigation District (the “District”) resolved to enter into the necessary contracts to issue and sell to the Department of Natural Resources and Conservation of the State of Montana one of more series of bonds (the “Bonds”) in a maximum principal amount not to exceed the amount necessary to pay the sum of a portion of the cost of constructing certain improvements to the Hedge Diversion dam owned by the District, including removing the dam and related improvements (the “Improvements”). The Court having reviewed the same and good cause appearing therefore,

IT IS HEREBY ORDERED pursuant to MCA Sec. 85-7-2014, that a public hearing on the Petition shall be set not less than 15 days from September 24, 2009, date of filing the Petition, and the public hearing of this petition is set before this Court in the Courtroom #2 at the Ravalli County Courthouse, Hamilton, Montana, on the 29th day of October, 2009, at 1:30 p.m. or as soon thereafter as the matter may be heard;

IT IS FURTHERED ORDERED that the clerk of this Court cause notice of said hearing to be given by publication at least once per week for at least two (2) weeks in a newspaper published or of general circulation in Ravalli County, Montana, and shall also give notice by posting written or printed copy of such notice in at least three (3) public places in each division of the District, the first of such publications and such postings to be not less than 15 days prior to the date fixed for the hearing.
