Ricky J. Haacke and Glenda J. The sale is a public sale and any person, including the Beneficiary, excepting only the Trustee, may bid at the sale. The bid price must be paid in cash at the time of sale. The Grantor, successor in interest to the Grantor, or any other person having an interest in the property, at any time prior to the Trustee’s Sale, may pay to the Beneficiary or the successor in interest to the Beneficiary the entire amount then due under the Deed of Trust and the obligation secured thereby (including costs and expenses actually incurred and attorney’s fees) other than such portion of the principal as would not then be due had no default occurred and thereby cure the default.

ADVERTISEMENT FOR ASBESTOS ABATEMENT: STEVENSVILLE SCHOOL FACILITIES

Stevensville Public Schools is soliciting sealed bids for asbestos abatement for three facilities on the school campus. Beginning at 10:00 AM on August 19thth, bid packets may be obtained from Pat Pfau at the Stevensville School District Offices at 300 Park Avenue, Stevensville MT 59870, by phone at 406-777-5481 ext. 136, or by e-mail at pfaup@stevensville.k12.mt.us. A non-mandatory pre-bid walk-through is scheduled for Thursday, August 26th at 10:00 AM.

To be considered, sealed bids must be physically received no later than 10:00 AM on September 2, 2010, at the School District Office location listed above. No faxed or electronic bids will be accepted. All bids will be publicly opened, read aloud, and taken under consideration. Bids must be honored for a period of 30 days after the bid opening.

As required by State Law, bids must be accompanied by a 10% bid security in an approved form. The successful bidder must provide a performance and payment bond in the amount of 100% of the contract amount as a condition of a successful contract execution. All workers who provide on-site labor must be paid no less than the current State of Montana Prevailing Wages or the current Federal Davis-Bacon Wages, whichever is greater. Wage requirements, effective at the time of bidding, are included in the bid packets. Certified payroll records will be required. This project is subject to the Montana State 1% Gross Receipts Tax. Successful bidders must possess a valid State of Montana Contractor Registration and be able to provide insurance coverages in the types and amounts shown in the bid packet.

Successful bidders shall give employment preference to bona-fide residents of Montana. A Montana resident bidder will be allowed preference against the bid of a non-resident bidder from any state or county that enforces a preference for resident bidders. Contractors shall comply with the Rules of On-Site Conduct included in the project manual. Background checks will be required for all persons providing on site services. The Stevensville Elementary School District reserves the right to reject all bids, reject individual non-responsive bids, or award the bid to the lowest responsible bidder.

NOTICE OF PUBLIC HEARING BEFORE STEVENSVILLE TOWN COUNCIL

MONDAY, AUGUST 30, 2010 AT 6:30 P.M.

A public hearing will be held on Monday, August 30, 2010 at 6:30 p.m. in the Town Council Chambers located at 206 Buck Street Stevensville, Montana to accept comment on a proposal by Territorial-Landworks, Inc. on behalf of John Anderson to amend certain conditions required for approval of Twin Creeks Subdivision. Specifically, as it applies to maintenance of common areas, size of proposed well field, and water rights approval. Details are available at Town Hall building located at 206 Buck Street, Stevensville for public review.

Letters of correspondence will be received in the office of the Town Clerk until 12 noon on Thursday, August 26, 2010.

NOTICE OF CHANGE TO BILLING CYCLE FOR SEWER CHARGE AND PUBLIC HEARING

NOTICE IS HEREBY GIVEN that on July 26, 2010, the Town Council (the “Council”) of the Town of Stevensville, Montana (the “Town”), adopted a Resolution of Intention of the Town of Stevensville, Montana to Modify the Billing Cycle for the Users of the Municipal Sewer System From Quarterly to Monthly and Conforming the Rates and Charges Accordingly.

The Council of the Town recently increased the rates and charges of the System following a public hearing pursuant to Resolution No. 255, adopted by the Council on May 10, 2010 (the “Prior Resolution”) and currently charges users of its municipal sewer system (the “System”) on a quarterly basis, as described in the Prior Resolution.

The Town utilizes an equivalent dwelling unit (EDU) methodology for imposing rates and charges, which is based on the size of the water line or meter servicing each connection. The Town currently charges users of the System a base rate charge per EDU per quarter (the “Base Rate Charge”). The Town also imposes a quarterly charge per EDU to pay debt service on the Town’s sewer revenue bonds (the “Debt Service Charge”). The sum of the Base Rate Charge plus the Debt Service Charge is referred to herein as the “Quarterly Charge.”

The Town intends to change its current quarterly billing cycle to a monthly billing cycle and implement such change effective as of its October 1, 2010 sewer billing, simultaneously with the effective date of an increase to the Town’s water rates and charges. The monthly sum of the Base Rate Charge plus the monthly Debt Service Charge is referred to herein as the Monthly Charge. The total dollar amount of the Quarterly Charge is not being increased; only the frequency of payment for sewer service is changing from quarterly to monthly. The Monthly Charge is derived by dividing the Quarterly Charge by three such that the sum of the Monthly Charges over a calendar quarter is equal to the Quarterly Charge.

On Monday, August 23, 2010, commencing at 6:30 p.m. at the Chambers of the Town Council, Town Hall, 206 Buck Street, Stevensville, Montana, the Council will conduct a public hearing and pass upon all protests against the proposed billing cycle change.
