Some 2010 ballot initiatives in circulation

Attorney fees awarded in Mitchell Slough case

In a ruling issued on December 2, 2009, Missoula District Judge Robert Deschamps III granted award of attorney’s fees to the Bitterroot River Protection Association (BRPA) in the Mitchell Slough case. BRPA sought fees from both the landowners along the slough and the Bitterroot Conservation District (BCD). The judge awarded the attorney’s fees to be paid to BRPA by the landowners, including Walter Babcock, Huey Lewis, Ken Siebel, Charles Schwab and others, as well as Marnell Corrao Associates, Inc., owner of the Double Fork Ranch, which intervened separately from the other landowners. The court found that the BCD would not be held liable for any of the fees. More...
