We can expect a hotly contested Senate confirmation hearing for Supreme Court appointee, Brett Kavanaugh, resembling a House of Commons brouhaha. Expect some yelling and throwing of sheaves of paper and news-media closeups of wild-eyed Senators.
There is little controversy over Kavanaugh’s competency or his impeccable juris credentials. His record speaks for itself being documented in countless cases and written opinions. There is little guesswork about the quality of the man or his judicial competency.
The sharp and heated controversy is over whether we want an activist court that usurps the lawmaking responsibilities of Congress. If you want a continued activist court then you should hate Kavanaugh. If you want the court to judge the execution of our laws according to the rule of law, then Kavanaugh is your man. It’s as simple as that.
Unpopular laws that have no chance of passing in Congress have, in the past, been strategically sent to the Supreme Court to make new laws by unelected judges. Many of our most controversial laws have been made that way. If you want to know which laws were made by judicial decree, just read the Progressive’s reasons why Kavanaugh must not be confirmed: They claim women’s rights, abortion rights, LGBTQ rights, Obamacare (ACA), and other controversial laws will be at risk if Kavanaugh is confirmed.
Any senator who refuses to meet with Kavanaugh, or who votes against him for reasons other than his suitability to sit on the court, is himself an ideologue that wants an activist Supreme Court to create laws by judicial decree.
