NOTICE IS HEREBY GIVEN by First Montana Title Company of Hamilton, Trustee, of Hamilton, Montana, of a public sale of real property hereinafter described, pursuant to the “Small Tract Financing Act of Montana” (Section 71-1-301, et seq., Montana Code Annotated). The following additional information is provided:

Description of Property Covered by Trust Indenture:
Lot 9A-2, Amended Subdivision Plat No. 536748, Smyth Addition No. 3, Ravalli County, Montana, according to the recorded plat thereof.
Trust Indenture Recording Data: The Real Estate Trust Indenture under which this sale is to be conducted is dated May 29, 2009 and recorded June 1, 2009 as Instrument No. 618067 of official records of Ravalli County, Montana.
Default: The default for which this foreclosure is made consists of the failure by the Grantor, or Grantor’s successor if any, to pay the amount of $2200.00 for each of the months of May through December, 2017 and January, February, March and April, 2018 and costs and attorney’s fees, TOGETHER WITH ANY DEFAULT IN THE PAYMENT OF RECURRING OBLIGATIONS AS THEY BECOME DUE. The total amount of past due payments is $26,532.00.
Sums Owing: The Beneficiary’s records indicate that the following sums are now due and owing to the Beneficiary from the Grantor or Grantor’s successor in interest on the obligation secured by said Trust Indenture:
Principal balance: $381,673.49
Accrued interest to May 9, 2018 at the rate of 5.625%: 6,341.71
Total principal and interest owing to May 9, 2018 (with interest accruing at $58.81954 per day)
TOTAL: $388,015.20
Beneficiary’s reasonable costs incurred for title report, filing and recording fees, trustee’s and attorney’s fees, expenditures for insurance and other costs for the preservation of its security, to and including the notice period prior to sale, with interest.
Election to Sell: The Beneficiary has elected and has directed in writing that the Trustee sell the real property, above described, for the satisfaction of the aforesaid obligations.
Date and Time of Sale: The sale will be held on September 20, 2018 at the hour of 10:00 o’clock a.m., Recognized Local Time.
Place of Sale: The sale will be held inside the front door at the Trustee’s usual place of business at 250 West Main Street, Hamilton, Montana 59840.
Terms of Sale: This sale is a public sale and any person, including the Beneficiary, excepting only the undersigned Trustee, may bid at the sale. The bid price must be paid in cash, with conveyance being made by Trustee’s Deed. The sale purchaser shall be entitled to possession of the property on the tenth (10th) day following the date of sale.
