Notice is hereby given to all interested parties that the above captioned case is pending in the Montana Twenty-First Judicial District, Ravalli County, Montana. The Plaintiff, Citizens for Fair Water, Inc. a Montana non-profit public-benefit corporation, has filed a complaint/petition for a declaratory judgment determining that the Defendant, Bitterroot Irrigation District (“BRID”), is the sole owner of the Three Mile Gravity Irrigation System (the System), is responsible for the continued maintenance of the System, and that no private irrigation entity was formed to own and operate the System. The Defendant, BRID, has denied the claims for relief in the complaint, raised certain affirmative defenses, and filed a counterclaim against the Plaintiff asking the court to declare that BRlD is not the owner of the System, that BRID’s obligation as financial sponsor ended upon repayment of financing obligations for the System, and that the users of the System are the owners of the System and are responsible for operation and maintenance of the System upon repaying of the financing obligations for the System. Plaintiff has denied the counterclaim.
The case is now pending before the District Court. Plaintiff and Defendant have filed cross motions for summary judgment. Each party has requested the court grant the relief it has sought, which could affect your legal rights. Therefore, this notice is being given to allow all interested parties an opportunity to review the matters pending before the court and, should any interested party deem it appropriate, to intervene or otherwise appear in this matter in accordance with the Montana Rules of Civil Procedure. Who can protest this license? What information must be included? (3) an indication that the letter is intended as a protest; (4) a description of the grounds for protesting; and (5) the protestor’s signature. What are valid protest grounds? The protest may be based on the applicant’s qualifications listed in 16-4-401, MCA, or the grounds for denial of an application in 16-4-405, MCA. Examples of valid protest grounds include: (1) the applicant is unlikely to operate the establishment in compliance with the law; (2) the proposed location cannot be properly policed by local authorities; and (3) the welfare of the people in the vicinity of the proposed location will be adversely and seriously affected.
How are protests submitted? Protests must be postmarked to the Department of Revenue, Office of Dispute Resolution, P.O. Box 5805, Helena, Montana 59604-5805 on or before June 9, 2017.
What happens if the license is protested? Depending on the number of protests and the protest grounds, a public hearing will be held in Helena or Stevensville. All valid protestors will be notified of the hearing’s time, date and location. Hearings typically are scheduled within 90 days. A protester’s hearing testimony is limited to the grounds in the protester’s letter. Following the hearing, the Department of Revenue will notify the public whether the license transfer is approved or denied.

At a regular board meeting of the Board of Trustees of School District No.2, Ravalli Connty, Montana, held on May 9, 2017, at 7:00 p.m. at the Stevensville Music Center Choir Room, the following resolution was introduced:
WHEREAS, the trustees of School District No.2, Ravalli County, Montana, have made a determination that as a result of an unforeseen need of the district that cannot be postponed until the next school year without affecting the educational functions of the district; and
WHEREAS, the trustees have determined that an amendment to the High School building reserve fund budget in the amount of $37,116.97 is necessary under the provision of Section 20-9-161 (6), MCA; and
WHEREAS, the anticipated source of financing the budget amendment expenditures shall be the High School building fund reserve;
THEREFORE, BE IT RESOLVED that the Board of Trustees of School District No.2, Ravalli County, Montana will meet at 7:00 p.m. at Stevensville Music Center Choir Room on June 13, 2017, for the purpose of considering and adopting the budget amendment.
