The application of local attorney Robert Myers, candidate for District Court Judge, to the U.S. Supreme Court for an injunction preventing the enforcement of federal District Court Judge Donald Molloy’s recent ruling against him was denied by Supreme Court Judge Anthony Kennedy on August 4th.
In July, Myers sought an injunction from U.S. District Court Judge Donald Molloy to prevent the enforcement of laws governing the statements of judicial candidates that were being invoked to prevent him from using a radio advertisement for his campaign. When Molloy denied his request, Myers made an application to the U.S. Supreme Court for an injunction to prevent Molloy’s ruling from going into effect pending appeal so that he could run the radio ad without fear of being prosecuted during his political campaign.
U.S. Supreme Court Judge Anthony Kennedy denied Myers’ application without offering any explanation. According to the Public Information Office of the Supreme Court of the United States, no explanation is generally ever given for a denial.
