BID SECURITY: Each Bid shall be accompanied by Bid Security made payable to OWNER in an amount of ten percent (10%) of the BIDDER’s maximum Bid price and in the form of cash, a cashier’s check, certified check, bank money order, or bank draft, in any case drawn and issued by a national banking association located in Montana or by any banking corporation incorporated under the laws of Montana; or a Bid Bond (on form attached if a form is prescribed) issued by a surety authorized to do business in Montana meeting the requirements of Paragraph 5.01 of the General Conditions. Bid Bonds shall be countersigned by a Resident Montana Agent. The bid security shall identify the same firm as is noted on the bid proposal forms. The bid bond shall act as a guarantee that the bidder, if his bid is accepted, will promptly execute the Contract, secure payment of worker’s compensation insurance, and furnish a satisfactory faithful performance bond in the amount of 100 percent of the contract price and a payment bond in the amount of 100 percent of the contract price.
BIDS TO REMAIN OPEN: The Bidder shall guarantee the Total Bid Price for a period of 90 calendar days from the date of bid opening.
Bidders are required to be licensed in accordance with and comply with the Public Contractors License Law of the State of Montana.
Proposals must be sealed and marked “City of Hamilton, Hamilton Well No. 5 Improvements Project, and marked “Sealed Bid” with the Contractor’s name, address, current state license number, class and federal tax identification number, or social security number, Montana Contractors Registration Number and be addressed to:

No facsimile bids will be accepted.
Any objection to published specifications must be filed in written form with the City Clerk prior to the scheduled time of bid opening. No bid will be considered which includes Federal excise tax, since the City is exempt therefrom and can furnish to the successful bidder certificates of exemption.
WAGE RATES: The Contractor shall not pay less than the latest Federal Davis Bacon Wage Rates as determined by the U.S. Secretary of Labor. A copy of said wage rate is attached as part of the specifications in Section 00825.
Bidder is subject to 18-2-401, et. Seq., Montana Code Annotated and amendments thereto and regulations issued there under, relating to prevailing wages, benefits, and other requirements. No claim for additional compensation will be allowed based upon a lack of knowledge or a misunderstanding of any such requirements by Bidder or failure to include in bid adequate increases in such wages over the term of the Contract.
PRE-BID CONFERENCE: Prospective bidders shall attend a mandatory pre-bid conference which will be conducted jointly by the Owner and Engineer at the Hamilton Public Works Building, 920 New York Avenue, Hamilton, Montana, 59840 at 2:00 p.m. on February 11, 2015.
PROJECT ADMINISTRATION: All questions relative to this project prior to the opening of bids shall be directed to the Engineer. It shall be understood, however, that no specification interpretation will be made by telephone, nor will any “or equal” products be considered for approval prior to award of contract. OWNER’S RIGHTS RESERVED: The Owner reserves the right to reject any or all bids, to waive any informality in a bid, or to accept the lowest responsive and responsible bid and bidder, and to make awards in the interest of the Owner. It is the intent of the Owner to award a Contract to the lowest responsive, responsible bidder on the basis of the combined total of the Base Bid Items No. 1, No. 2, No. 3, and No. 4. Bidders must include lump sum and unit price bid prices as appropriate for all Bid Items No. 1 through No. 4. Bids received that do not include pricing for all Bid Items will be considered non-responsive. The purpose and intent of using such a basis of award is to allow the Owner to construct the greatest possible number of Bid Items, based upon the responsible bids received and the funding available. The Owner reserves the right to authorize construction of any combination of, or all of, the base bid items at the bid amounts presented in the Contractor’s Bid Proposal.

INVITATION TO BID
Sealed bids will be received at the City Clerk’s Office at 223 South 2nd Street, Hamilton, MT 59840, until 10:00 a.m. local time on February 25, 2015, for construction of the Fairgrounds Road – Phase 2 Road Reconstruction Project, and will then be publicly opened and read aloud at 10:00 a.m. within the Community Room at City Hall, 223 South 2nd Street, Hamilton, MT. The work consists of constructing improvements to Fairgrounds Road in Hamilton, Montana from Highway 93 to Old Corvallis Road. Improvements include road reconstruction including demolition of existing and installation of new concrete curb and gutter, asphalt street paving, sidewalks, detectable warning surfaces, storm drainage structures, excavation, signal work, signs, pavement markings, landscaping and associated work. All work must be substantially completed within 60 calendar days after the commencement date stated in the notice to proceed. The anticipated NTP will be early June 2015.
The contract documents may be examined or obtained, upon paying a non-refundable fee of $50.00, by contacting the Engineer, WGM Group, Inc., 1111 E. Broadway, Missoula, MT, 59802, (406) 728-4611. Attn: Jon Gass. An additional charge of $5.00 will be applied for shipping and handling, if required. Contractor’s submitting a bid must have an official Bid Set of documents obtained from the Engineer.
Bids shall be submitted on the forms provided in the Contract Documents. Bids shall include a bid bond made payable to Owner in an amount of 10% of the total bid, and be addressed to City Clerk’s Office at 223 South 2nd Street, Hamilton, MT 59840. No facsimile bids will be accepted. After award, successful bidder must furnish an approved Performance and Payment bond of 100% of the contract. Montana law requires all contractors to register with the Department of Labor prior to execution of the contract agreement.
Prospective bidders are encouraged to attend a pre-bid conference, which will be conducted jointly by the Owner and Engineer at the City of Hamilton Public Works Department, 920 New York Avenue, Hamilton, MT at 10:00 a.m. on February 11, 2015, with an optional walk-through of the project site upon completion of the meeting.

Notice of Application for Air Quality Permit (pursuant to Section 75-2-211, and 75-2-215, MCA, and the Air Quality Rules), J&J Escavating & Trucking Inc. will file on or about 1/23/15 an application for a Montana Air Quality Permit or an alternation to an existing Montan air Quality permit from the Montnaa Department of Environmental Quality (Department).
