THE FOLLOWING LEGALLY DESCRIBED TRUST PROPERTY TO BE SOLD FOR CASH AT TRUSTEE’S SALE. Notice is hereby given that the undersigned trustee will, on August 25, 2014, at the hour of 10:00 AM sell at public auction to the highest bidder for cash, the interest in the following described real property which the Grantor has or had power to convey at the time of execution by him of the said Deed of Trust, together with any interest which the Grantor his successors in interest acquired after the execution of said Deed of Trust, to satisfy the obligations thereby secured and the costs and expenses of sale, including reasonable charge by the Trustee, at the following place: At the North entrance of the County Courthouse, 205 Bedford, Hamilton, MT.

The default of the obligation, the performance of which is secured by the aforementioned Deed of Trust, and for which default of this foreclosure is made, is for failure to pay the monthly payments as and when due.
Pursuant to the provisions of the Deed of Trust, the Beneficiary has exercised, and hereby exercises, its option to declare the full amount secured by such Deed of Trust immediately due and payable. There presently is due on said obligation the principal sum of $25,381.11 plus interest at a rate of 6.75% totaling $1,943.20, late charges in the amount of $256.00, property taxes paid by Beneficiary in the amount of $256.00, as of April 11, 2014, plus the costs of foreclosure, attorney’s fees, trustee’s fees, escrow closing fees, and other accruing costs.
The Beneficiary has elected, and does hereby elect, to sell the above-described property to satisfy the obligation referenced above. The Beneficiary declares that the Grantor is in default as described above and demands that the Trustee sell the property described above in accordance with the terms and provisions of this Notice. The sale is a public sale and any person, including the beneficiary, excepting only the Trustee, may bid at the sale. The bid price must be paid in cash. The conveyance will be made by a limited warranty Trustee’s Deed. The purchase shall be entitled to possession of the property on the 10th day following the sale.
The sale may be postponed by up to 15 days for any reason by public proclamation at the scheduled sale. If there is a stay by bankruptcy or court order, the sale may be postponed up to 30 days at a time by public proclamation, for a total of no more than 120 days.
The grantor, successor in interest to the grantor or any other person having an interest in the property, at any time prior to the Trustee’s Sale, may pay to the beneficiary the entire amount then due under the Trust Indenture and the obligation secured thereby (including costs and expenses actually incurred and attorney’s fees) other than such portion of the principal as would not then be due had no default occurred and thereby cure the default theretofore existing.
