Packaging practices for commodities are such that the purchaser is presented a container of a given size but discovers upon opening that the container is only one half full. This circumstance is the result of a practice referred to “Nonfunctional Slack Fill” by those within the industry.
The Food and Drug Administration (FDA) offers six “Safe Haven” exceptions allowing the practice: 1. Product Protection, 2. Machinery Requirements, 3. Unavoidable Settling, 4. Specific Functionality, 5. Reusable Containers, 6. Manufacturing Limitations.
The observation might be made that none of the allowable exceptions function to protect the consumer. “Shrinkflation” is the term applied to those situations where
the occurrence is not justifiable under any of the previously named six exceptions. “Opaque Packaging” is the industry term used to describe the practice. It is illegal but rarely enforced.
The public is being sold goods the volume of which is one half of what was expected and possibly of lower quality. The introduction would lead one to believe the subject is a discussion about Congress rather than consumer goods.
Actually, it’s both, but the point to be made is that the public has purchased a commodity, Congress, that is one half of what was expected and of sub standard quality. There are striking similarities. The Legislative body consumes capital at an astonishing rate, produces an endless array of hearings and produces little more than showboating before the Media. The public is getting about one half of the performance paid for. It is a primary symptom of all the problems present.
The only solution to the present state of affairs is an Article 5 Convention of States. This is the only viable means available to the public.
