NOTICE OF TRUSTEE’S SALE
THE FOLLOWING LEGALLY DESCRIBED TRUST PROPERTY TO BE SOLD FOR CASH AS TRUSTEE’S SALE. Notice is hereby given that the undersigned trustee will, on May 17, 2024, at the hour of 10:00 AM sell at public auction to the highest bidder for cash, the interest in the following described real property which the Grantor has or had power to convey at the time of execution by her of the said Deed of Trust, together with any interest which the Grantor and her successors in interest acquired after the execution of said Deed of Trust, to satisfy the obligations thereby secured and the costs and expenses of sale, including reasonable charges by the Trustee, at the following place: At the North entrance of the County Courthouse, 205 Bedford, Hamilton, Montana.
Myrna J. Buchholz, as Beneficiary of a certain Deed of Trust, hereinafter described, gives notice that the Beneficiary, as a result of a default under the terms and conditions of said Deed of Trust, has elected to consider all the principal and interest due and has elected to sell the hereinafter described property in satisfaction of the obligation.
The said Deed of Trust was executed by the Grantor, Jan B. Palmquist, on the 30th day of January, 2012, to the Trustee, Title Insurance of Montana with its principal office in Hamilton, Montana, specifically reserving and granting to Trustee power of sale. Said Deed of Trust was filed for record on the 30th day of January, 2012 as Document No. 650911 Trust/Ind, records of Ravalli County, Montana. Jan B. Palmquist subsequently conveyed her interest in the real property to Beth A. Palmquist, Trustee, The Beth A. Palmquist Trust Dated September 14, 2004 on August 13, 2012 which deed was recorded on December 3, 2012 as Document: 661226 Quit Claim, records of Ravalli County, Montana.
The said Deed of Trust is security for a Promissory Note Secured executed on the 30th day of January, 2012 by Jan B. Palmquist, payable to the order of Ernest E. Buchholz and Myrna J. Buchholz. The Promissory Note Secured was modified by the Modification to Terms of Promissory Note Dated January 30, 2012 and Agreement on Application of Insurance Proceeds / Instruction to Escrow Agent dated March 3, 2017. Myrna J. Buchholz succeeded to the interests of Ernest E. Buchholz, now deceased.
Myrna J. Buchholz, Beneficiary, appointed John D. Greef, P.O. Box 1926, Hamilton, Montana 59840, as successor trustee by instrument dated the 11th day of January, 2024, and recorded on the 12th day of January, 2024, as Document No. 793144, records of Ravalli County, Montana.
Said Deed of Trust encumbers the following described real property, which does not exceed forty (40) acres in area, situated in Ravalli County, Montana.
E½NE¼NW¼ of Section 19, Township 7 North, Range 19 West, P.M.M., Ravalli County, Montana, and being more particularly described as Parcel 31, Certificate of Survey No. 2302.
Property Address: 1216 Corvallis Hills Drive, Corvallis, Montana
The default of the obligation, the performance of which is secured by the aforementioned Deed of Trust, and for which default this foreclosure is made, is for failure to pay the monthly payment due on December 20, 2023 and for failure to pay the entire remaining principal and interest balance when due on September 30, 2018 according to the terms of the balloon payment date required by the Modification to Terms of Promissory Note Dated January 30, 2012 and Agreement on Application of Insurance Proceeds / Instruction to Escrow Agent dated March 3, 2017.
Pursuant to the provisions of the Deed of Trust, the Beneficiary has exercised, and hereby exercises, her option to declare the full amount secured by such Deed of Trust immediately due and payable. There is due on said obligation as of January 12, 2024 the principal and interest sum of $112,852.01. This figure includes one late payment penalty charge of $125. The principal balance accrues interest at a rate of 7% per annum or a per diem interest amount in the sum of $21.40. In addition to the balance due, other costs of the payoff of the Promissory note include the costs of foreclosure, attorney’s fees, trustee’s fees, escrow closing fees, foreclosure report, and other accruing costs.
The Beneficiary has elected, and does hereby elect, to sell the above-described property to satisfy the obligation referenced above. The Beneficiary declares that the Grantor is in default as described above and demands that the Trustee sell the property described above in accordance with the terms and provisions of this Notice.
