Notice to Warm Springs Creek Water Users
Randall & Dawn Demorest have filed a Motion to Amend Warm Springs Creek Statement of Claim 76H 6461-00 with the Montana Water Court. The Demorests seek to correct the flow rate for the claim to 3.75 cfs from the decreed flow rate for this claim was 134.l3 gpm, or 0.30 cfs. The DNRC reduced the claimed flow rate based on their 17 gpm/acre guideline, resulting in the 134.13 gpm decreed flow rate. The Demorests allege as much as 3.75 cfs is diverted under this claim when enough water is available in the spring during high water. Most of the year, far less than the maximum flow rate is available for diversion by the Demorests. The Claimant alleges the claimed flow rate of 3.75 cfs accurately reflects the maximum flow rate based on historical use.
Objection Date:
Any response or objection to the Motion to Amend must be filed with the Montana Water Court, PO Box 1389, Bozeman, MT 59771-1389, by June 27, 2016, in accordance Section 85-2-233(6), MCA.
