REQUEST FOR PROPOSALS FOR WATER RIGHTS ATTORNEY
TOWN OF STEVENSVILLE, MT
The TOWN OF STEVENSVILLE in Ravalli County is soliciting proposals from interested legal firms to provide contract legal services to the Town. Work will be related to water rights applications and transfers necessary to complete the Town’s water system improvement project. The selected legal firm will need to prepare the required water rights applications with assistance from the Town’s Engineer, and successfully guide the Town through the water rights process.
The services to be provided include, but are not limited to:
Thorough assessment of existing water rights and boundaries. Review of Twin Creeks water right and boundary;
Preparation of a change of place of use application to include all areas served by the Town’s water system, including Twin Creeks subdivision, in the municipal water rights boundary. Application to adjust the Twin Creeks Service area to include the municipal water rights boundary.
Prepare application for change of point of diversion for four (4) new groundwater wells to be drilled on Town well field.
Prepare application for new water rights for increased use since water rights were perfected in 1994.
Further legal support and assistance as needed.
Responses to this RFP should include:
Firm Qualifications. Should included the firm’s legal name, address and telephone number. Background of the firm and a brief history, and qualifications of the firm in performing this type of work should also be included;
Assigned firm members qualifications. The experience, qualifications and availability of the staff to be assigned to the project. Pertinent staff members resumes should be included;
A description of the firm’s prior water rights experience, a list of previous water rights applications filed, and the name and contact information of references knowledgeable of the firm’s performance regarding water rights. Include at least three (3) references;
A description of the firm’s anticipated availability during the term of the project;
A proposed work plan and schedule for the activities to be performed;
Fee Structure. Include rates for each member of the project team and fees for non-legal services.
Respondents will be evaluated according to the following factors:
Qualifications of the Firm – 10%
Qualifications of assigned firm members – 30%
Prior experience of firm with water rights projects – 30%
Anticipated Availability – 20%
References – 10%
The Town may select the firm based on an evaluation of the written proposals or select several finalists to be interviewed. This solicitation is being offered according to Federal and State statutes governing the procurement of professional services. Accordingly, the Town Council reserves the right to negotiate an agreement based on fair and reasonable compensation for the scope of work and services proposed, as well as the right to reject any and all responses deemed unqualified, unsatisfactory or inappropriate. REVISED ADVERTISEMENT FOR BIDS: SITE WORK – STEVENSVILLE PUBLIC SCHOOLS
This offering has been modified. The bid date has been changed to Tuesday, June 28, 2011 and a mandatory pre-bid meeting has been scheduled for Thursday, June 16, 2011 at 1:00 PM at the project site.
Stevensville Elementary School District is soliciting sealed bids for construction of site work including grading and drainage structures, asphalt pavement, concrete walkways, fencing, and associated work. Beginning at noon on Wednesday June 8, 2011 bid packets may be obtained from Scott Bruner at Swank Enterprises by phone: 406-752-5411; E-mail: scott@swankenterprises.com; or in person at 750 West Reserve Drive, Kalispell, MT 59901. No plan deposit will be required. No plans will be available from the School District.
This project utilizes the Construction Manager at Risk method, and Swank Enterprises of Kalispell has previously been selected as the Construction Manager. This project is offered with two bidding options. 1) Bidders who can provide the required bid and performance securities may bid directly to the School District. 2) Bidders who elect not to provide the required security documents may bid to Swank Enterprises as a subcontractor. Contact Swank Enterprises as described above for further information. All subcontracts, regardless of bidding method, will be performed under Swank Enterprises as the Construction Manager at Risk.
A mandatory pre-bid walk-through has been scheduled for Thursday June 16, 2011 at the project site at 300 Park Avenue in Stevensville. Bids will not be accepted from bidders who do not attend this meeting and sign the attendance sheet.
To be considered, sealed bids must be physically received no later than 1:00 PM local time on June 28, 2011 at the Stevensville School District at 300 Park Avenue, Stevensville, MT. No faxed or electronic bids will be accepted. Bidders who elect to bid as subcontractors to Swank Enterprises must coordinate and complete a separate private bidding process with Swank prior to the public bid opening. If your bid is responsive, Swank will submit your number as Swank’s bid with appropriate mark-ups. All bids, including those submitted by Swank, will be publicly opened, read aloud, and taken under consideration by the School District. No awards will be made at the bid opening. Bids must be honored for a period of 30 days after the bid opening. A bid tabulation will be made available as soon as is practical after the bid opening, including a tabulation of those bids made to Swank.
As required by State Law, bids submitted to the School District must be accompanied by a 10% bid security in an approved form. The successful bidder must provide a performance and payment bond in the amount of 100% of the contract amount as a condition of a successful contract execution, under Swank Enterprises. All workers who provide on-site labor must be paid no less than the current State of Montana Prevailing Wages or the current Federal Davis-Bacon Wages, whichever is greater. Wage scale requirements, effective at the time of bidding, are included in the bid packet. Certified payroll records will be required. This project is subject to the Montana State 1% Gross Receipts Tax. Successful bidders must possess a valid State of Montana Contractor Registration and must be able to provide insurance coverages in the types and amounts shown in the bid packet.
Successful bidders shall give employment preference to bona-fide residents of Montana. A Montana resident bidder will be allowed preference against the bid of a non-resident bidder from any state or county that enforces a preference for resident bidders. Contractors shall comply with the Rules of On-Site Conduct included in the project manual. Background checks will be required for all persons providing on site services. The Stevensville School District reserves the right to reject all bids, reject individual non-responsive bids, or award the bid to the lowest responsible bidder.

LEGAL AD FOR The FLATIRON RANCH SUBDIVISION
The Ravalli County Planning Board will conduct a second public meeting on the FlatIron Ranch major subdivision on Wednesday, June 8, 2011 at 7:00 p.m. The Planning Board held the first public meeting on the proposal on January 5, 2011.The meeting will be held in the County Commissioners meeting room at the County Administrative Center, located at 215 South 4th Street in Hamilton. The subdivision proposes to create 389 residential lots, three lots for condominiums, and four lots for commercial purposes. There are 162 condominium units proposed on the three condominium lots, for a grand total of 551 residential units proposed within the subdivision. The subdivision is proposed to be developed on 451 acres, and be filed in 15 phases over 30 years. The subdivision is proposed off Golf Course Road, east of the City of Hamilton, as shown on the associated map. The public may be allowed to provide spoken comment at the Planning Board public hearing, and all written public comments will be entered into the record. It is anticipated that the Planning Board will make a recommendation to the County Commissioners at the conclusion of the meeting. All written comments received by the date of the Planning Board meeting will be forwarded to the County Commissioners for their consideration.
The Board of County Commissioners will hold a public hearing on the proposed subdivision on Thursday, June 30, 2011 beginning at 9:00 a.m. in the County Commissioners meeting room at the County Administrative Center, located at 215 South 4th Street in Hamilton. The public may comment on the proposal verbally and in writing. However, please note that only under select circumstances will new information be allowed into the record after the public hearing.
